Welcome to City Website Dezigners ("Company," "we," "us," or "our"). These Terms of Service ("Terms") govern your use of our website located at [https://citywebsitedezigners.com/](https://citywebsitedezigners.com/) (the "Site") and the web design, hosting, marketing, and AI automation services provided by us (collectively, the "Services").

By accessing or using our Services, enrolling in a monthly plan, or authorizing a website build, you agree to be bound by these Terms.

1. Description of Services & $0 Setup Model

  • Build Offer: We provide custom website design and setup with no upfront build fees ($0 setup fee) when tied to an active, paid monthly subscription plan for managed hosting, platform access, and AI automation features.

  • Subscription Services: Monthly plans include web hosting, routine maintenance, software access (including GHL-powered tools such as AI Web Chat, AI Voice agents, SMS/email marketing features, and review management), and Google Business Profile (GBP) setup, depending on the tier selected.

2. Subscription Fees, Billing, and Cancellations

  • Recurring Billing: All recurring subscription fees are billed in advance on a monthly basis. You authorize us to store your payment method and charge the recurring fee on your monthly billing cycle date.

  • Website Ownership & Minimum Commitment: Because the initial website build cost is absorbed by us under a $0 setup fee, the custom website layout, code, and design assets hosted on our infrastructure remain the property of City Website Dezigners during the active subscription period.

  • Cancellation Policy: You may cancel your monthly subscription at any time with a 30-day written notice prior to your next billing cycle. Upon cancellation:

    • Access to hosting, CRM features, AI chat/voice tools, and automated review campaigns will terminate at the end of the paid billing period.

    • If you wish to transfer/export your website design and assets to an independent host upon cancellation, a standard design release/offboarding fee may apply if canceled within the first 12 months.

3. Client Responsibilities & Content

  • You are solely responsible for providing necessary brand assets (e.g., logos, images, text content, business details) required to complete the website build.

  • You represent that you own or hold the necessary rights to all content and intellectual property you provide to us.

4. Messaging, SMS, and AI Services

  • SMS & A2P Compliance: If your plan includes SMS messaging or review automation, you agree to comply with all local, state, and federal messaging regulations (e.g., TCPA, CTIA guidelines). You must ensure your customers opt in to receive communications from your business.

  • AI Features: AI Chatbots and AI Voice agents are automated tools meant to assist customer inquiries and capture leads. While configured to act on your provided business information, City Website Dezigners is not liable for errors, misstatements, or missed appointments generated by automated AI interactions.

5. Limitation of Liability

To the maximum extent permitted by law, City Website Dezigners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of our Services, downtime, or third-party platform integrations.

6. Modifications to Terms

We reserve the right to update these Terms at any time. Continued use of the Services following any updates constitutes acceptance of the new Terms.
